“Defendant Dykeman and two companions were riding in an automobile owned by him which went out of control as a result of excessive speed and turned over, killing a girl also riding in the vehicle. Defendant was charged with reckless driving under city ordinance but was acquitted on his defense that he was not the driver of the car. When brought to trial for manslaughter he filed a plea of former jeopardy which was overruled. This was correct, for reckless driving and involuntary manslaughter are distinct offenses. Furthermore, Code 1950, section 19-232, was inapplicable since it relates only to former convictions where an act is a violation of two or more statutes or ordinances. In the instant case defendant had been acquitted.” Dykeman v. Com., 201 Va. 807, 113 S.E.2d 867 Va. 1960.
