Fact that automobile passenger had been making faces and moving his hands up and down before police officer stopped automobile for traffic infraction did not give officers reasonable suspicion that passenger had committed, was committing, or was about to commit felony and, thus, did not justify asking passenger to get out of car; it was possible that passenger made gestures after seeing police officers display camera, automobile had been stopped for failure to display city automobile license, and there was no indication that driver or passenger had been considered to be a threat. Bethea v. Com,12 Va.App. 303, 404 S.E.2d 65 (1991). and in the same case itself the court observed that, “Passengers in automobiles that are stopped for routine traffic infractions have right to personal safety and privacy that shields them from intrusion of being ordered out of car unless there is some basis for reasonable suspicion of criminal activity.
