“Plaintiff Edith Smith was injured in a collision while riding as a guest in the car of Mrs. Anderson, who was killed in the accident. In plaintiff’s action for damages against Mrs. Anderson’s executor the record showed that the accident occurred at night on the open highway and that the collision was due entirely to the act of Mrs. Anderson in driving on the wrong side of the road, which was straight and level, affording unobstructed view of oncoming vehicles for half a mile. The only reasonable explanation of her act was that she was asleep or recklessly inattentive to the safety of her passengers. Under either view the question of her gross negligence was correctly submitted to the jury, who returned a verdict for plaintiff.” Smith v. Smith, 199 Va. 55, 97 S.E.2d 907 Va. 1957.
