Virginia reckless driving Speeding Ticket Driving on Suspended License
Plaintiff recovered a verdict of $6,000 for injuries received when his vehicle collided with a truck of the Metal Products company driven by one Mundy, as the truck was making a left turn from the highway to enter a filling station. The accident occurred shortly after noon on a clear, dry day. Plaintiff testified he first saw the truck as he reached the crest of a hill some 600 feet away, and saw its light signalling for a left turn. He concluded, however, that the vehicle was stopped, so increased his speed (witnesses said to 70 or 80 miles an hour) and could not stop in time when the truck cut in front of him. On these facts plaintiff was held contributorily negligent as a matter of law in failing to keep his vehicle under complete control after receiving the truck’s signal and in driving at excessive speed; hence the verdict in his favor was set aside and final judgment entered for defendants.
