“In action against driver of automobile for injuries to guest passenger which resulted when defendant attempted to pass automobile and third automobile attempted to pass through space between defendant’s automobile and automobile defendant was passing, and third automobile brushed against defendant’s automobile, frightening defendant and causing defendant to slip or be thrown under wheel, with result that defendant’s automobile swerved from highway and traveled some distance and finally collided with a culvert, defendant was not guilty of gross negligence under evidence in failing to regain composure and control of defendant’s automobile and in failing to avoid striking culvert.” Lloyd v.
