“The fact that imposition of some fines by justices of the peace in certain town for motorists’ noncompliance with signs, authorized by state traffic commission on state roads outside any city or village, in prosecutions improperly based on superseded statute, may have preceded enactment of amendatory statute, subjecting motorists failing to obey traffic signs on such roads to penalties provided by statute directing payment of fines to municipalities, does not justify dismissal of state’s action against town for amount of such fines paid to defendant, though it may affect amount of recovery”. People v. Town of Yorktown 36 N.Y.S.2d 83 N.Y. Sup. (1942).
