In the instant case, an action for injuries received by plaintiff in crossing an intersection, the evidence showed that defendant drove to the left of another car and pulled around it until he was abreast of the second car, and that this maneuver so confused plaintiff, who was in the intersection waiting to permit the cars to proceed past him, that he jumped straight into the path of the second car, which struck him, inflicting the injuries for which he was seeking compensation. The trial court struck plaintiff’s evidence on the ground that it failed to show any negligence by defendant. Held: That if defendant pulled around the car ahead of him at the intersection, even though he did not completely pass, he violated the terms of section 2154(109), subdivision (c), of the Code of 1936.
