“Truck driver, who in violation of statutes did not give signal to make left turn at intersection, started his turn before reaching center of intersection, and failed to use reasonable care to see that his turn could be made in safety, was guilty of negligence but was not guilty of gross negligence and therefore was not liable to his guest for injuries sustained as result of collision with automobile which was attempting to pass while truck driver was making left turn. In Railway Exp. Agency, Inc., of Va. v. Moore , 201 Va. 928, 114 S.E.2d 626 Va. (1960), the court observed that, “On entering intersection it was duty of motorcyclist to look with reasonable care, and motorcyclist had no absolute duty to discover truck entering intersection from private parking lot unless it was in such plain view that by looking with reasonable care the motorcyclist was bound to have seen the truck in time to have avoided the collision.”

In action against motorist by pedestrian for injuries sustained when struck by automobile while attempting to cross highway, evidence established that pedestrian was guilty of negligence. DeMuth v. Curtiss,188 Va. 249, 49 S.E.2d 250.(1948). and in the same case itself, the court observed that, “In action against motorist by pedestrian to recover under last clear chance doctrine for injuries sustained when struck by automobile while attempting to cross highway, burden was on pedestrian to prove that she occupied a position of danger at such a time that motorist, in exercise of reasonable care, should have discovered pedestrian in time to have avoided the accident”.

The Virginia Beach Circuit Court in Oliver v. Forsyth held that a truck driver who stopped at stop sign, before entering through highway, had duty only to look with reasonable care at traffic on through highway, and did not have an absolute duty to discover by looking, unless the thing to be looked for was in such plain view that looking with reasonable care was bound to have discovered it.
