Issue:
  • Whether evidence was sufficient that defendant recklessly drove through the parking lot at an excessive speed?
Discussions:

As the driver returned to her parked car in a mall parking lot, a truck blocked her vision on her left side. Consequently, the driver pulled out of the parking space very cautiously and slowly. Without warning, defendant’s vehicle collided violently with the driver’s car, hitting the left front wheel and quarter panel. The impact was forceful enough to break the driver’s front axle and badly damaged the entire front end of defendant’s vehicle, leaving the bumper bracket pushed into the radiator and the bumper dislodged and dragging the ground on the right side. The appellate court found that the evidence provided ample support for the trial court’s factual finding that defendant recklessly drove through the parking lot at an excessive speed that endangered the driver’s life, limb, or property. The extent of damage to both cars provided mute evidence of high speed, permitting the factfinder to infer a reckless rate of speed despite defendant’s self-serving and contradictory estimates. Consequently, the evidence was sufficient to support defendant’s conviction for reckless driving in a parking lot in violation of § 46.2-864.c
