Virginia reckless driving Speeding Ticket Driving on Suspended License

In Frazier v. Com., Not Reported in S.E.2d, 2002 WL 31163615 Va.App.,2002, Appellant contends on appeal that the evidence was not sufficient to prove his driving endangered “the life, limb or property of any person,” in violation of Code § 46.2-852. The Court held that, The statement of facts indicates appellant argued in closing that Flood Road was not a “highway … and the credibility of the witnesses.” We cannot say that simply intoning the words “and the credibility of the witnesses” would put a trial court on notice that appellant was challenging the sufficiency of the evidence as to whether appellant was driving in a reckless fashion. The phrase, “credibility of the witnesses,” does not preserve the issue presented. Taken in the context of his closing argument, appellant appeared to address the credibility of the witnesses on the issue of whether Flood Road was a “highway,” not their credibility on other elements of the crime. Appellant did not alert the trial court that he was arguing the Commonwealth failed to prove the elements of the offense of reckless driving. We find the sufficiency issue raised by appellant on appeal is procedurally defaulted under Rule 5A:18.

In the instant case, an action for injuries received by plaintiff in crossing an intersection, the evidence showed that defendant drove to the left of another car and pulled around it until he was abreast of the second car, and that this maneuver so confused plaintiff, who was in the intersection waiting to permit the cars to proceed past him, that he jumped straight into the path of the second car, which struck him, inflicting the injuries for which he was seeking compensation. The trial court struck plaintiff’s evidence on the ground that it failed to show any negligence by defendant. Held: That if defendant pulled around the car ahead of him at the intersection, even though he did not completely pass, he violated the terms of section 2154(109), subdivision (c), of the Code of 1936. Holland v. Edelblute, 179 Va. 685, 20 S.E.2d 506 Va. 1942.

“Action against driver of automobile for injuries to guest passenger which resulted when defendant attempted to pass another automobile and a third automobile came from behind and attempted to pass through space between defendant’s automobile and automobile defendant was passing, and such third automobile brushed against defendant’s automobile, frightening defendant and causing defendant to slip or be thrown under wheel, with result that defendant’s automobile swerved from highway and traveled some distance and finally collided with a culvert. The Circuit Court rendered a judgment for plaintiff and defendant brought error. The Supreme Court of Appeals held that defendant was not guilty of gross negligence under evidence in failing to regain some degree of composure and control of defendant’s automobile and in failing to avoid striking culvert.” Lloyd v. Green, 194 Va. 948, 76 S.E.2d 190 Va. 1953.

In Smith v. Lamar, 212 Va. 820, 188 S.E.2d 72 Va. 1972, the Supreme Court held that where at time accident occurred police officer was in pursuit of and seeking to overtake and stop a law violator, and his red light was on and his siren was sounding, statute which exempts police officers from regulations in certain emergencies was applicable. The Court further held that standard of care which would customarily be required of ordinary motorist did not apply to police officer in hot pursuit of a law violator.

“In the instant case plaintiff was struck by defendant’s car at a street crossing. The driver of the car testified that he was forty feet from plaintiff when he first saw him. Plaintiff testified that he saw the car when it was seventy feet from him. Defendant testified that he was going at the rate of ten miles an hour. Plaintiff testified that the car was going so fast he did not think it safe to cross the street in front of it. Plaintiff’s testimony was corroborated by the fact that the car ran seventy feet before it stopped after the accident. Held: That the jury was warranted in finding that the car was traveling at a reckless rate of speed and that defendant was guilty of negligence in not keeping a proper lookout or slackening the speed of the car.” Adkins v. Young, Men’s Christian Ass’n of Lynchburg, 149 Va. 193, 141 S.E. 117 Va. 1928.
