“Under statute creating qualified exemption from traffic laws for drivers of emergency vehicles, police officer’s conduct in pursuing suspected lawbreaker may not form basis of civil liability to injured bystander unless officer acted with reckless disregard for safety of others; standard demands more than showing of lack of due care under circumstances, and requires evidence that actor has intentionally done act of unreasonable character in disregard of known or obvious risk that was so great as to make it highly probable that harm would follow and has done so with conscious indifference to outcome”. Saarinen v. Kerr 84 N.Y.2d 494, 644 N.E.2d 988 N.Y.,(1994).
