In plaintiff’s action for damages against Mrs. Anderson’s executor the record showed that the accident occurred at night on the open highway and that the collision was due entirely to the act of Mrs. Anderson in driving on the wrong side of the road, which was straight and level, affording unobstructed view of oncoming vehicles for half a mile. The only reasonable explanation of her act was that she was asleep or recklessly inattentive to the safety of her passengers. “Action against driver of automobile for injuries to guest passenger which resulted when defendant attempted to pass another automobile and a third automobile came from behind and attempted to pass through space between defendant’s automobile and automobile defendant was passing, and such third automobile brushed against defendant’s automobile, frightening defendant and causing defendant to slip or be thrown under wheel, with result that defendant’s automobile swerved from highway and traveled some distance and finally collided with a culvert. The Circuit Court rendered a judgment for plaintiff and defendant brought error.
