Should I be concerned if I get a reckless driving ticket in Fairfax, Arlignton or Falls Church?

Some courts in Virginia are known to be harsher than other courts in Virginia.

For example, the rule of thumb in the Fairfax County VA Courts & Fairfax City VA Court is that if you are charged with reckless driving at a speed in excess of 80 mph, you will lose your license. The Virginia Beach Circuit Court addressed the issue of whether a person impeded the flow of traffic in Davis v. Scarborough.  The Circuit Court of the City of Virginia Beach analyzed Virginia Code Section 46-256 as part of their analysis. Virginia Code Section 46-256 stated as follows:

*105 ‘No vehicle shall be stopped in such a manner as to impede or render dangerous the use of the highway by others, except in the case of an emergency as the result of an accident or mechanical breakdown, in which case the vehicle shall be removed from the highway as soon as possible; and such removal may be ordered by a police officer at the expense of the owner if the disabled vehicle creates a traffic hazard.

‘No vehicle shall be stopped except close to and parallel to the right-hand edge of the curb or roadway, except that a vehicle may be stopped close to and parallel to the left-hand curb or edge of roadway on one-way streets or may be parked at an angle where permitted by the State Highway Commission or local authorities with respect to streets and highways under their jurisdiction.‘

This section forbids one to stop a vehicle on the highway ‘in such a manner as to impede or render dangerous the use of the highway by others‘, but the prohibition is not absolute. It is not made unlawful to stop unless such action impedes traffic or renders use of the highway dangerous.

The Virginia Beach Circuit Court in Edwards v. City of Virginia Beach  held that the test for determining whether a way is a “highway” depends upon the degree to which the way is open to public use for vehicular traffic.’   The Virginia Beach Circuit Court relied on Roberts v. Commonwealth, 28 Va.App. 401, 403, 504 S.E.2d 890, 891 (1998) for this holding.
