“Plaintiff Hailey was injured while a guest passenger in Johnson’s automobile. Johnson, called as an adverse witness, testified that the accident occurred while he was driving on a road familiar to him, at about forty miles an hour; that as he approached a curve he swerved to miss some dogs and lost control of the vehicle, which crashed against a tree. Hailey testified the accident occurred as the result of Johnson going a ‘little too fast‘ around the curve. There was impartial evidence that a speed of forty miles per hour was reasonable under the circumstances. On this evidence no gross negligence was shown, even accepting plaintiff’s theory, and the court committed no error in setting aside a verdict for plaintiff.” Hailey v.
