“Plaintiff Hailey was injured while a guest passenger in Johnson’s automobile. Johnson, called as an adverse witness, testified that the accident occurred while he was driving on a road familiar to him, at about forty miles an hour; that as he approached a curve he swerved to miss some dogs and lost control of the vehicle, which crashed against a tree. Hailey testified the accident occurred as the result of Johnson going a ‘little too fast‘ around the curve. There was impartial evidence that a speed of forty miles per hour was reasonable under the circumstances.
