“A motorist who, before attempting to pass to right of preceding truck as truck turned to left, had been traveling at 20 miles an hour about two or two and a half car lengths in rear of truck, and who lacked only an inch and a half of clearing the truck, was not guilty of “gross negligence” rendering her liable for injuries sustained by guest, in absence of evidence that automobile was not under control before collision occurred, notwithstanding that automobile after striking truck, ran over curb and into pole and tree and that at moment of impact guest exclaimed, “You can’t make it.” Lennon v.
