VIRGINIA RECKLESS DRIVING LAWS

There are many types of Virginia reckless driving laws. The following are some of the different reckless driving laws in Virginia:

•Reckless driving – speeding in excess of 80 mph (11 years)
•Reckless driving – speeding 20 mph or more above the posted speed limit (11 years)

The Virginia Division of Motor Vehicles (DMV) will place a conviction for a reckless driving ticket on your record for a minimum of 5 years and in most cases, the conviction will remain on your driving record for a maximum of 11 years.

“Code § 18.2-266(i) provides: It shall be unlawful for any person to drive or operate any motor vehicle, engine or train (i) while such person has a blood alcohol concentration of 0.08 percent or more by weight by volume or 0.08 grams or more per 210 liters of breath as indicated by a chemical test administered as provided in this article….” Yap v. Com., 49 Va.App. 622, 643 S.E.2d 523 Va.App.,2007.

Northern Virginia Traffic Ticket Speeding Ticket Reckless Driving

“Code § 18.2-266 proscribes driving while under the influence of alcohol, and Code § 18.2-270 provides that a violation of that statute is a Class 1 misdemeanor. Prior to July 1, 1990, Code § 18.2-11 provided that the maximum punishment for a Class 1 misdemeanor was twelve months in jail and/or a $1,000 fine. Code § 15.1-132 grants cities within the state the authority to enact similar ordinances for driving while under the influence. Under that statute, “[s]uch ordinances may provide the same penalties … as are provided by general law for similar offenses,” but “[n]o such ordinance shall provide for a lesser punishment.” Also applicable is Code § 15.1-901. Prior to February 21, 1991, that code section limited the penalties imposed by any municipal ordinance enacted pursuant to state authority to “a fine of $1,000 or imprisonment … for twelve months.” Penton v. City of Norfolk , 16 Va.App. 141, 428 S.E.2d 309 Va.App.,1993.

“Code § 18.2-268.2 provides, in relevant part, as follows: A. Any person … who operates a motor vehicle upon a highway … in this Commonwealth shall be deemed thereby, as a condition of such operation, to have consented to have samples of his blood, breath, or both blood and breath taken for a chemical test to determine the alcohol, drug, or both alcohol and drug content of his blood, if he is arrested for a violation of § 18.2-266 … within two hours of the alleged offense. B. Any person so arrested … shall submit to a breath test. If the breath test is unavailable or the person is physically unable to submit to the breath test, a blood test shall be given….” Goodman v. Com., 37 Va.App. 374, 558 S.E.2d 555 Va.App.,2002.

“Article 2 of Chapter 7 of the Code of Virginia includes a section making it “unlawful for any person to drive or operate any motor vehicle … while under the influence of alcohol.” Code § 18.2-266. Article 2 also includes provisions regulating probation, education and rehabilitation of a person convicted under Code § 18.2-266. See Code § 18.2-271.1.” Smith v.
